Terms for Dafne

These Terms of Use govern your use of the Dafne app, website, and related services. Please read them carefully before using Dafne.

1. Provider and scope

Dafne is provided by Michael Reimer, Am Langenbach 10, 48308 Senden, Germany. Dafne means the mobile app, the website at dafne.talk, the API, account features, voice and text conversations, in-app purchases, subscriptions, and related services.

If you obtain Dafne through the Apple App Store, Google Play, or another platform, the terms of that platform also apply. Mandatory store rules take precedence where they apply to your purchase or download.

2. Eligibility

Dafne is currently intended for adult users. You may use Dafne only if you are at least 18 years old or the age of majority in your country, if that age is higher.

You are responsible for providing accurate information and for using login providers, devices, and credentials securely. If you believe your account has been misused, contact us without delay.

3. Account, sign-in, and account deletion

Dafne may offer guest use, Sign in with Apple, Sign in with Google, and email/password sign-in. Some features may require an account, a verified email address, or a valid payment status.

You can request deletion of your account and related data through the channels provided in the app or on the website. More information is available on the account deletion page. Legal retention duties, billing records, security logs, and legitimate evidence interests may limit immediate deletion of certain data.

4. AI features and important limitations

Dafne is an AI-powered conversation app. Responses may be incomplete, inaccurate, outdated, or unsuitable for your specific situation. You are responsible for reviewing outputs and for not relying on Dafne alone for important decisions.

Dafne does not replace medical, psychological, legal, tax, financial, or other professional advice. In emergencies, crises, self-harm risks, risks to others, medical issues, or legally or financially significant decisions, you must contact appropriate professional help or emergency services.

Roleplays, interviews, coaches, panels, and other modes are simulated AI conversations. They are not real relationships, diagnoses, assessments, guarantees, professional services, or binding recommendations.

5. Acceptable use

You must not:

  • use Dafne for unlawful, fraudulent, harassing, discriminatory, or abusive purposes.
  • threaten, defame, dox, intimidate, or deliberately harm people or groups.
  • enter or request content that promotes child sexual exploitation, non-consensual sexual content, calls for violence, self-harm, hate, terrorism, or other serious harm.
  • circumvent safety mechanisms, age restrictions, rate limits, payment restrictions, or access restrictions.
  • crawl, scrape, overload, or reverse engineer Dafne except where mandatory law permits it.
  • present outputs as professional medical, psychological, legal, financial, or other expert advice.

We may restrict, suspend, or terminate content, accounts, or access if there is a reasonable suspicion of misuse, security risks, payment fraud, store violations, or legal violations.

6. Your content and conversations

You keep your rights in content you enter into Dafne. However, you grant us the rights required to process, transmit, store, analyze, and share that content with technical service providers as necessary to provide, secure, bill, improve, or legally administer Dafne.

Dafne may store transcripts, messages, metadata, account data, and usage data. Details are explained in the Privacy Policy.

7. Rights in Dafne and AI outputs

Dafne, the app, website, software, marks, designs, text, graphics, audio elements, modes, prompts, system logic, and other components belong to the provider or their respective rights holders. You receive only a limited, revocable, non-transferable right to use Dafne for private purposes under these Terms.

To the extent legally possible, you may use AI outputs for your own private purposes. We do not guarantee that outputs are unique, accurate, free of third-party rights, or suitable for any particular purpose. The same or similar outputs may be generated for other users.

8. Plans, in-app purchases, subscriptions, and minutes

Dafne may offer free use, usage-based minutes, one-time purchases, subscriptions, promotion codes, or other plans. Prices, terms, renewals, cancellations, refunds, and taxes are shown in the relevant store or in the app.

Payments through Apple or Google are generally processed by the respective store. Subscriptions renew under the displayed store terms unless you cancel them in time through your store account. Refunds are primarily governed by the applicable store rules and mandatory consumer law.

Voice minutes, credits, promotion codes, and plan benefits are not transferable, not redeemable for cash, and may expire where this is stated in the app, store, or applicable offer terms.

9. Availability and changes

We aim to provide stable operation, but we do not guarantee uninterrupted availability, error-free operation, or specific response times. Maintenance, updates, store reviews, third-party outages, network issues, or security reasons may restrict use.

We may develop, replace, restrict, or discontinue features, modes, voices, models, limits, prices, plans, and technical requirements where this is necessary for operation, security, law, economic viability, or product development.

10. Third-party services

Dafne uses technical service providers and platforms such as OpenAI, Supabase, Fly.io, Vercel, Apple, Google, Resend, and other providers where necessary for app operation, AI features, sign-in, email, payments, security, or hosting. Third-party terms may apply.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and in all other cases where limitation of liability is prohibited by law.

In cases of simple negligence, we are liable only for breach of essential contractual obligations whose fulfillment enables proper use of Dafne and on whose compliance you may regularly rely. In that case, liability is limited to foreseeable, typical damage.

We do not assume liability that AI outputs are accurate, complete, current, legally reliable, or suitable for your purpose, unless mandatory law provides otherwise.

12. Termination and suspension

You may stop using Dafne at any time and request account deletion. You may also need to cancel active subscriptions separately in your Apple App Store or Google Play account.

We may suspend or terminate your access if you violate these Terms, payments fail, security risks exist, or we are required to do so by law or store rules.

13. Special terms for Apple users

  • These Terms are concluded between you and the provider, not Apple. The provider is solely responsible for Dafne and its content.
  • Apple has no obligation to provide maintenance or support for Dafne.
  • To the extent permitted by law, warranty, product liability, support, and claims are directed to the provider and not Apple.
  • You may use Dafne only on Apple-branded devices that you own or control and only as permitted by the Apple Media Services Usage Rules.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms where Dafne is obtained through the Apple App Store.

14. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected where legally applicable.

15. Changes to these Terms

We may update these Terms if Dafne, the legal situation, store requirements, technical processes, or our business model changes. The current version will be published on this page. For material changes, we will inform you in an appropriate manner where required.
